Prosecutorial supervision covers all branches of law of the Republic of Belarus. The prosecutor’s office of the Central District of Minsk continuously monitors the accurate and uniform implementation of laws, decrees, decrees and other regulatory legal acts by republican government bodies and other state organizations subordinate to the Council of Ministers of the Republic of Belarus, local representative, executive and administrative bodies, public associations, religious organizations and other organizations, officials and other citizens, including the individual loyal entrepreneurs.
The prosecution authorities oversee compliance with public procurement legislation in the Republic of Belarus. The fundamental regulatory legal acts in this area are the Law of the Republic of Belarus dated 13.07.2012 No. 419-Z “On public procurement of goods (works, services)”, the resolution of the Council of Ministers of the Republic of Belarus dated 22.08.2012 No. 778 “On some measures for the implementation of the Law of the Republic Belarus “On state purchases of goods (works, services)”, as well as Decree of the President of the Republic of Belarus dated December 31, 2013 No. 590 “On some issues of state purchases of goods (works, services)”.
As part of the oversight of compliance with public procurement legislation, the prosecutor’s office of the Central District of Minsk monitors the official website of the National Center for Marketing and Price Study RUE on the global computer network www.icetrade.by (hereinafter referred to as the official website), which was created for posting on him information on public procurement and acts of legislation on public procurement.
During 2017, the prosecutor’s office of the Central District of Minsk issued 5 orders to eliminate violations of the law on public procurement regarding violations of the procedure for posting information on public procurement on the official website.
Also in the above period, the prosecutor’s office of the Central District of Minsk sent 5 official warnings to the organization’s officials about possible disciplinary or administrative liability for violating public procurement laws.
We explain that for violation of the law on public procurement, parts 4-5 of article 11.16 of the Code of the Republic of Belarus on administrative offenses, administrative liability is provided in the form of a fine in the amount of up to 100 basic units.
